Please read first. Hello Moti is an AI-powered study companion, not a human teacher, therapist, medical professional, emergency service, or substitute for appropriate adult supervision. An adult parent or legal guardian must create and control the account.
These Terms of Use (the "Terms") form a binding agreement between the adult who creates or uses an account ("you", "Parent", or "Account Holder") and Avatud OÜ ("Avatud", "we", "us", or "our") regarding access to Hello Moti through hellomoti.app and related applications, features, and services (collectively, the "Service"). By creating an account, purchasing Moti Time, or allowing a child to use the Service, you agree to these Terms.
1. About Hello Moti
Hello Moti provides real-time, voice-based AI interactions intended to support learning, homework practice, explanations, study habits, and age-adapted educational activities. The Service may adapt its language, prompts, and activity suggestions using the child profile and previous session summaries.
The Service clearly identifies Moti as an AI system. You must not present Moti to a child as a human being or encourage the child to rely on Moti as a secret keeper, emergency contact, or replacement for trusted adults.
2. Adult account and child profiles
- Only an individual who is at least 18 years old and legally capable of entering into a contract may create an account, accept these Terms, provide consent, and make purchases.
- The Account Holder must be the child's parent, legal guardian, or another adult legally authorised to make decisions about the child's use of the Service and personal data.
- Hello Moti is designed for children aged 6 to 17. The Account Holder chooses whether the Service is suitable for a particular child and is responsible for age-appropriate supervision.
- A child does not enter into a contract with Avatud and may not independently create a paid account or submit payment details.
- You must provide accurate information and must not create a child profile without the required authority and consent.
Where local law requires a specific form of parental consent or age verification, we may ask you to complete additional verification before a child profile or voice session is activated. We may restrict access in a country where the Service cannot be lawfully offered.
3. Parental responsibility and supervision
As the Account Holder, you are responsible for:
- reviewing these Terms and our Privacy Policy before enabling a child to use the Service;
- explaining to the child, in age-appropriate language, that Moti is an AI system and that conversations are processed electronically;
- deciding what subjects, homework, documents, and personal information the child may discuss;
- ensuring that the child does not share passwords, full addresses, contact details, financial details, government identifiers, or other unnecessary sensitive information;
- monitoring use where reasonably appropriate for the child's age, maturity, and circumstances; and
- contacting a qualified teacher, doctor, therapist, emergency service, or other professional where human assistance is needed.
4. Account security
You are responsible for safeguarding your login credentials and all activity under your account. You must promptly notify us at team@hellomoti.app if you suspect unauthorised access. We may require re-authentication, suspend sessions, or reset credentials to protect the account or the child.
Google sign-in may be offered as an authentication method. Your use of Google's services is also governed by Google's own terms and privacy policy. We receive only the account data necessary for sign-in, such as the adult Account Holder's name, email address, and authentication identifier.
5. AI-generated responses and educational limitations
AI can be wrong. Moti may misunderstand speech, provide incomplete or inaccurate information, or generate content that is not suitable for a particular assignment or child. Important answers should be checked against trusted educational materials or a qualified adult.
- Hello Moti does not guarantee grades, learning outcomes, exam results, curriculum alignment, or uninterrupted availability.
- The Service is not authorised to diagnose learning difficulties, developmental conditions, medical issues, or mental health conditions.
- The Service must not be used to cheat, impersonate a student, complete a closed-book assessment, or violate school or examination rules.
- The Service may decline, redirect, or end a conversation when automated safety systems identify potentially harmful, illegal, sexual, violent, self-harm, exploitative, or otherwise inappropriate content.
Hello Moti is not continuously monitored by a human and cannot reliably identify every risk, contact emergency services, or guarantee that a parent will be alerted. In an emergency, stop using the Service and contact local emergency services or a trusted adult immediately.
6. Moti Time, free access, prices, and taxes
Access may be offered through a free trial or prepaid units of usage time ("Moti Time"). The amount of Moti Time, price, currency, and any applicable taxes are shown before purchase. Unless the checkout page states otherwise, purchased Moti Time is valid for 12 months from the purchase date and expires after that period.
- Moti Time is linked to the Account Holder's account and is not cash, stored value, electronic money, or a transferable financial instrument.
- Moti Time may not be resold, transferred between unrelated accounts, exchanged for cash, or used for unlawful purposes.
- Time is normally deducted while a live AI session is active. Minor differences may occur because of connection setup, reconnection, rounding, or technical processing.
- Promotional or free Moti Time may have a shorter validity period and may be withdrawn if obtained through abuse or error.
Payments are processed by Stripe or another payment provider shown at checkout. We do not receive or store complete payment-card numbers. Your bank or payment provider may charge currency conversion or other fees that are outside our control.
7. Cancellation, withdrawal, and refunds
Our voluntary refund policy allows the Account Holder to request cancellation and a refund within 14 days after purchase only if none of the purchased Moti Time has been used. A package is considered started once any portion of the purchased Moti Time is consumed.
- To request a refund, email team@hellomoti.app from the account email and identify the purchase.
- Approved refunds are returned to the original payment method where reasonably possible. Processing times depend on Stripe, the bank, and the payment method.
- Free, promotional, expired, transferred, chargeback-related, or fraudulently obtained time is not refundable.
- If a technical failure attributable to us prevents material use of paid Moti Time, we may restore time, extend validity, or issue a refund as appropriate.
Nothing in this section limits mandatory consumer rights. If the law that applies to you provides a longer withdrawal period, a proportional refund after performance begins, remedies for non-conforming digital services, or another non-waivable right, that law prevails. At checkout, we may ask you to request immediate access to the digital service and acknowledge how starting to use Moti Time affects the voluntary refund policy and any statutory withdrawal right.
8. Acceptable use
You must not, and must not allow a child or any other person to:
- use the Service for unlawful, exploitative, abusive, sexual, violent, hateful, harassing, self-harm-promoting, or dangerous activity;
- solicit or disclose unnecessary personal data about another person, especially another child;
- attempt to bypass safety controls, age controls, authentication, rate limits, billing, or access restrictions;
- reverse engineer, scrape, copy, resell, benchmark for competitive publication, or systematically extract the Service or its outputs except where applicable law expressly permits;
- upload malware, interfere with systems, probe vulnerabilities, or use automated tools that place an unreasonable load on the Service;
- infringe copyright, privacy, confidentiality, publicity, or other rights; or
- use the Service in or for a sanctioned territory, restricted person, prohibited end use, or any purpose that would cause Avatud or its providers to violate applicable trade controls.
9. Materials provided by the Account Holder or child
You retain the rights you have in homework prompts, text, voice input, documents, and other material submitted to the Service ("User Content"). You grant Avatud a limited, worldwide, non-exclusive licence to host, transmit, process, adapt, and display User Content only as needed to operate, secure, improve the reliability of, and provide the Service in accordance with our Privacy Policy.
You must have the right to submit User Content. Do not upload confidential school records, copyrighted textbooks in breach of licence terms, personal data about other children, or material that the Account Holder is not authorised to share.
10. Intellectual property
The Service, brand, software, design, characters, interfaces, and related materials are owned by Avatud or its licensors and are protected by intellectual-property laws. Subject to these Terms, Avatud grants the Account Holder a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for the family's private educational use.
To the extent permitted by law and subject to third-party rights, you may use AI-generated responses for personal educational purposes. AI output may not be unique, and other users may receive similar output. Avatud does not guarantee that output is copyrightable, non-infringing, or suitable for publication.
11. Privacy and voice processing
Our Privacy Policy explains how we process adult and child data. Hello Moti does not create or keep audio recordings in its own application database. During a session, live voice data and conversation content are transmitted to an AI service provider for real-time processing. After the session, Hello Moti stores a short session summary, topics covered, progress information, and technical usage data; it does not store a full conversation transcript as part of the child's learning record.
Third-party infrastructure may process or temporarily retain inputs and outputs under its own contractual data-handling terms. Details and available controls are described in the Privacy Policy.
12. Third-party services
The Service relies on third parties, including Google for authentication, OpenAI for real-time AI processing, Stripe for payments, and cloud hosting, database, email, security, and support providers. Their systems may be unavailable or changed without our control. We remain responsible for our own obligations but do not control independent services you choose to use directly.
13. Changes, maintenance, and availability
We may update models, voices, characters, features, safety controls, supported languages, prices, or technical requirements. We may suspend access for maintenance, security, legal compliance, provider outages, suspected abuse, or risk to a child or another person. We will make reasonable efforts to avoid materially reducing paid functionality without an appropriate remedy where required by law.
14. Suspension and termination
You may stop using the Service at any time and may request account deletion. We may suspend or terminate access if you materially breach these Terms, fail to pay, misuse the Service, create risk, or if continued service would be unlawful or technically impracticable. Where reasonable, we will provide notice and an opportunity to correct the issue.
Termination does not automatically create a refund right. Any refund or restoration of unused time will be determined under Section 7 and mandatory law. Sections that by their nature should survive termination, including intellectual property, payment records, disclaimers, liability, and dispute terms, remain effective.
15. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, educational outcome, and uninterrupted or error-free operation. We do not disclaim warranties or rights that cannot lawfully be excluded for consumers.
16. Limitation of liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, wilful misconduct, breach of non-waivable consumer rights, or any liability that cannot legally be limited.
Subject to the paragraph above, Avatud is not liable for indirect, incidental, special, punitive, or consequential loss, loss of data, loss of educational opportunity, or reliance on inaccurate AI output. To the extent a monetary cap is permitted, Avatud's total liability arising from the Service during the 12 months before the event giving rise to the claim is limited to the greater of (a) the amount you paid for the Service during that period or (b) EUR 100.
The limitations apply only to the extent permitted in your jurisdiction. Mandatory consumer remedies remain available.
17. Governing law and disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your habitual residence.
Please contact us first at team@hellomoti.app so we can try to resolve a concern. Any dispute that is not resolved informally may be brought before the competent courts of Estonia, except where mandatory consumer law allows or requires proceedings in another court or dispute-resolution body.
18. Changes to these Terms
We may update these Terms to reflect legal, safety, technical, or business changes. The effective date appears at the beginning. If a change materially affects an existing paid package or the way a child uses the Service, we will provide reasonable notice through the account or by email. Continued use after the effective date constitutes acceptance where permitted by law; otherwise, we will request fresh agreement.
19. General provisions
- If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue to apply.
- A failure to enforce a provision is not a waiver.
- You may not assign the account or these Terms without our written consent. We may assign these Terms as part of a merger, reorganisation, financing, or transfer of the Service, subject to applicable law.
- These Terms, together with the Privacy Policy and Cookie Policy, are the complete agreement concerning the Service, except for mandatory rights and any terms expressly shown at checkout.
- The English version controls to the extent permitted by law. Translations are provided for convenience, but mandatory local-language consumer rights remain unaffected.
